The imported "bull" thistle is an invasive in the US. However, there are thistles that are native to California and to other parts of the N. A. Continent (E.G.: Canadian Thistle), so you can find thistles that you can legally grow in your part of California. In fact, many of the native thistles are considered endangered/threatened so their plantings are not illegal, but are actually encouraged, (check your county extension office about which ones you can get).
BTW, I am sure that most of you know that the worlds largest thistle is commercially grown California and in many other parts of the world. And commands a hefty price at times.
