    Bankruptcy Laws

    There must be a couple legal eagles on this board....was wondering...pure speculation of course...

    Do the new bankruptcy laws let folks keep their clothes? Makes sense right? So if a person were to buy so many kilts and accessories they went into bankruptcy they'd still get to keep the kilts and accessories right...because they were clothing?

    Not in any danger of bankruptcy, far from it.

    Just, somehow - knowing that is true would be very reassuring....

    I don't know for certain, but it's probably got some specific notion about "reasonable" amounts, whatever that means. It would have to have something in order to keep people from buying up a bunch of fur coats to hide funds.

    The kilts jackets brogues would probably escape liquidation. Sporrans, pins flys etc now we are getting into the grey, Define clothing. It is always the reasonableness test. Look at the colleciton-- are 45 kits really reasonable? I think the answer is yes, and as the proud owner of 3 an two unfinished am very envious.

    I would make sure that you had burned or given away all your pants. Then defend the number of kilts you have by stating that they are needed for different weather conditions including how strong the wind is blowing.

    The only way a kilt is going to be of interest to the Bankruptcy folks is if it is collectable. Despite the fact that many of us basically 'collect' kilts, having way more than is considered reasonable, the simple fact is that we are collecting that which is not collectable. Our kilts, except for possibly a few of Ham's, are all considered non-durable items of clothing which hold no real value beyond what they'd bring at a garage sale.

    Sooooo, about the only way your wildly out of control kilt addiction is going to impact on a bankruptcy is for your lawyer to discover it, be suffering from the same addiction and barter his fees with you. I recommend you only tell him how many kilts you have if he asks you specifically ... don't go a braggin'.

    Otherwise, believe it or not, the Bankruptcy Court doesn't want your clothes, food, family jewels (both kinds), collection of seady VCR tapes or even you electronics and furniture ... they will take your guns, though, because guns, like other collectables that increase in value over time, can and will be sold for the purpose of reducing your debts. You can keep your ammo, ironically.

    So spend freely on your kilts, bretheren, and know that even when all else is lost the more kilts you have the bigger tent you can build down by the river. Just keep one to wear so that you will ever be able to .....

    KILT ON!!
