Exercise caution with Flasks

While having a lengthy mind numbing discussion regarding flasks, keep in mind that some states, namely Texas, take a negative view on alcohol in a flask. This is considered an open container and depending upon the police offer and surrounding circumstances it could result in being processed at the station (ie spending the night at the grey bar motel) and spending endless hours sitting in a courtroom where being kilted runs the high risk of offending the court. Courts in Texas are and have been quite conservative for some time.

While flasks can be a gorgeous addition, it is what is inside the flask that could make for a bad situation worse. This note comes in the heels of having to represent 2 clients for DWI in Houston Texas, one who was in possession of a flask. As Harris County, Texas leads the nation in DWI's it puts the prosecution in a hard position with almost no room to negotiate.

Heard of one guy who had a very special bottle of 37 yr old Bowmore, the one that I read was a cool grand a bottle. Anyhow he had opened it at his birthday party in the office and on the way home was pulled over for speeding. The cop spotted the bottle and took it and poured it out before letting him drive away with traffic tickets in hand. Murphys law.

If its in the trunk of a car or locked in the glove box in a truck a lot of times they let it pass.

whew that sounds like trouble in houston. im too old to want to interject myself into additional volatile situations. i get enough of that fun from diffusing some of Judges powder kegs at work. highland games, likeminded individuals, low threat situations. pubs here have too many unknown variables.
