Ah, but there is a precedent; just ask L.L. Bean and their use of the Maine tartan which got them in some hot water recently:

And for the record, I tend to support L.L. Bean in this instance (I also support them wi' my money!) but I think the example is a sound one.

So, for those who would buy an FC IOS kilt. If you found out it was not licensed, what would you do?

I wouldn't buy if the weaver, whoever they may be, wasn't licensed to produce the tartan.
This thread smacks of an earlier thread about this same sort of thing. And I was quite disappointed with FC's response in this specific post.
However, if everything is licensed as it should be and my budget was inorder, I would definitely consider buying an FC IoS kilt. Their products seem to have gotten decent reviews and the prices are decent.

Let's not jump to any conclusions until "the Marks" from FC have had a chance to respond, eh? I'm sure they're aware of the issue, now.
There's no reason at all to get hot under the collar about any of this until that happens, and hopefully even then, all will be well. I just brought up the licensing issue to raise awareness, not start a riot!

Has anyone purchased one yet?? I have been drooling over the MM swatch I ordered a few months ago. The funds are almost there for me to order from there, and I still think I will, but I am interested in hearing about the FC kilt.

Honestly? Still wear it .
Fortunatly I'm getting my IoS from MacHummel at Canadian Casual Kilts. I'll be paying the royalties on my yardage*, not Pete, as this cost is passed on to the end user.
I checked FC's website, there is no additional cost for Isle of Skye, it is also clled Island of Skye during checkout.
*And gladly for the honour or this beautiful tartan. Heay it's only a couple of $.

How perfectly silly has this become?
If someone gave you a stolen car, would you accept it and drive it?
Is it acceptable to rob a bank, if no proof can be brought to arrest you?
Right is right, gentlemen. And wrong is wrong. At no time ever does wrong become right, just because you managed to get over on someone. It's OK to get over on someone else, but if it were to happen to you, the howling would be endless. Some of this is enough to give me the boak.
How about we bring some facts to this thread and put an end to the speculation?

I agree with Mike.
And we've been over this issue with Frugal Corner before. I suggest interested parties go and re-read the thread that Rampant Lion linked to a few posts ago. Given what Mike just said, here's a couple of relevant quotes from that earlier thread.
I wrote, commenting directly on FC's use of the copyrighted Pride of Scotland (MacColl's of Aberdeen) and Isle of Skye (Mrs. Rosemary Samios, liscenced to Lochcarron) tartans:
If a tartan, for instance, is a proprietary design that is protected by law in the UK, the fact that you are having your products made in Pakistan and are selling them in the USA may mean that those protections instituted in the UK are not enforceable (or at least not easily so). But that doesn't make it right.
Frugal Corner responded by saying:
we are a US company, operating in the USA, we are subject to USA laws, and laws that are enforceable here in the USA. We are not subject to ENGLISH Laws-at least not since 1776, nor are we subject to laws in China, Mexico, or Brazil...
Now, I have a great deal of respect for you and you are a very knowledgable Gentlemen (and fair) but as to the RIGHT thing, now we can get into an ethics debate which will lean towards opinions.
What Rocky, Mike, and others have pointed out is very true. We don't know if FC has permission to have this tartan produced. We don't know if their source for the cloth has acquired permission to have this tartan produce. So it would be premature of us to assume anything.
However -- and this is a big however -- I think that FC's public track record in this regard is sufficient that a bit of skepticism and caution is more than justified. So while I don't think there is need for any more public speculation, I do think it would be a good idea for those interested parties to investigate the issue. The most straightforward way to do this is to simply ask Frugal Corner before making a purchase if indeed they are liscenced to have that tartan produced, of are buying it from a liscenced producer.
