    Tartans are copyrighted, unless you used a tartan as a particular mark of your business (say, it was the distinct color of your shipping boxes and logo), in which case it could be registered as a trademark.

    Yes, "Designed in Scotland" is indicia of the notorious G____ Brothers, espeically if the tag is pale yellow with a green border.
