Matt Newsome had a custom variant based on his original design for the XMTS tartan woven for an X Marker. The last three official runs have been the same as the background you see here. Other than that all the XMTS tartan kilts out there are the result from one of these runs. There was a problem with the third run by Fraiser and Kirkbright that required a re-weaving. The damaged remanants of the first try of that run were sold in Fraiser and Kirkbrights seconds (this favric fell into the hands of several X Markers).
If a kiltmaker decides to stock up on fabric from this run that is their business. As Steve has indicated, we will be doing this in again in a year or so.
I do not believe the tartan is trademarked (though it is registered with the STA), but any true X Marker would want to get permission from the owner of the site or the designer of tartan to have it woven.
