Nice write up about a kilt store in Missouri

Jerry Dyer said wearing a kilt has little-known benefits.
"What you'll find is they're chick magnets," he said, making air quotes with his fingers around the words "chick magnets."
Dyer and his wife, Rhonda, own Thistle & Clover on Main Street in St. Charles. It is the only place in St. Charles County where one can buy a traditional kilt made to measure by crafts people in Scotland.
It is also a place where customers can rent this woolen aphrodisiac for a prom or wedding if they don't want to make the commitment of going full kilt.

Thanks for bringing this article to our attention, but I must say, for a group of people who are forever being set off by alleged copyright violations when it comes to tartan, violating the copyrights of others doesn't set off many alarm bells.
Posting an entire article is not only bad form, it is a violation. Newspapers certainly appreciate being mentioned, and - in general - don't mind a short excerpt accompanied by a link. But posting someone else's work in it's entirety isn't right.

So you say. As you know doubt have noticed I always include the author, publication and a link. The problem with links is that they often go dead within a day or so. Very frustrating when people go back and try to read old post. Kind of defeats the purpose. How is posting here different then keeping a cache of the website, or a mirror copy?
Do you really think that the St. Charles Journal is losing revenue because someone on this worldwide board read the article on this forum? Its not as if they would have run out and bought copy of the paper, and no one is exploiting this intellectual property for commercial gain. (Which separate this posting from the practices you referred to.) I frankly have my hands full with the kilt police. I really don't need self-appointed members of the media police as well. I will hence forth neuter my postings.

The reposting of an article offered for free on the paper's website, with citation to the original source, and offered without an attempt of the reposter to profit, on a site whose purpose is not to report St. Charles news, would likely fall under the free use exemption of the federal copyright laws.
On a more positive note, I'm glad to see the kilt flourish anywhere, but especially glad to see it flourish in my home state of Missouri. My parents still live there and forbade me from wearing a kilt when I visit. What would the neighbors think!

Aye, St. Charles is quite kilt-friendly (save one restaurant downtown), since the Missouri Tartan Day festivities are held there every April! St. Louis is also very kilt-friendly, and even Springfield is getting better. (I can't speak for KC, so I'll defer to ChatttanCat and/or others on that topic)

Yes, the Journal is losing revenue. They make money when people visit their website - by selling the ads you see. Exactly the same as with a print copy; when you buy a newspaper, the price doesn't begin to cover the cost of printing and distributing it. The revenue stream is in the ads.
And it is definitely NOT Fair Use to distribute an entire article. It would be Fair Use to use a brief quote/excerpt, especially when accompanied by a link to the original.

I spend quite a bit of time protecting my own paper's intellectual property; it's something we take quite seriously. Generally, people comply pretty quickly with a take down notice. Those who don't, probably end up with some large legal bills. I'd hate to see a forum I enjoy so much end up with a major hassle b/c of IP violations.
A rule of thumb: posting a paragraph or two, and maybe a photo, with a link to the original isn't going to ruffle (many) feathers. Redistributing content can, and likely will at some point, cause problems.

Is there any chance that this thread could find it's way back to discussing kilts?
I'm sure that there's a forum for copyright problems out there somewhere and that's where this discussion should go.
If anybody has a problem with other forum members posting articles then they should take it up with the moderators and not drag it out in the forum.

Wow I just spent 4 days kilted vacation in St. Louis and I could have stopped in and checked them out. I also noticed that the gentleman is not wearing a kilt.

Hey I know that place, I bought my last kilt from them at the Scottish Games last year. My wife and I shop there quite a bit.
