In the USA? Yes. You start running into trouble when you sell it, though. As long as you make it for your own personal use, and the use of your friends, you can make your own booze until you turn green.

it's more or less the same in Canada.
but up here you can also rent your distilling equipment to others so they can make there own beer, wine or hard liquor.

There are actually limits. I don't know about distilled products, but you are leagally only supposed to make 50 gallons of beer (don't know how anyone would know, but it is the law).

No Red Oak Casks.
The oak casks used to mature Scotch whisky have been used previously for maturing Bourbon (mainly) or other spirits, such as sherry or wine.
95% of the these casks are made from American white oak.

According to the Epicurious website, "The favorite wood for wine barrels is white oak (red oak is too porous), with the U.S. species differing slightly from European"

So it appears you have little to worry about. And that calls for a drink!
