To answer your question both directly and with my observations:

1) With my observations - we've been selling the Scottish / Scotland's National tartan for 15 years and have never had anyone question the meaning / political affiliation.

2) Directly from the Tartan Register (who has it listed as "Scottish National" https://www.tartanregister.gov.uk/ta...tails?ref=3730 )... emphasis mine:

STA ref: 2154
STWR ref: 2154
Designer: King, Michael
Tartan date: 01/01/1994
Registration date: This tartan was recorded prior to the launch of The Scottish Register of Tartans.
Category: Fashion
Registration notes: Designed originally for the Scottish National Party but now manufactured and sold without the political association. There is some similarity in the proportions of the sett to the National Tartan produced by the Scottish Woollen Manufacturers Association in 1934. The tartan has been recorded by the Scottish Tartans Society.1994.
