    As long as it has not been 30 days since the completion of the auction, and you paid with Paypal, you can file a paypal grievance and they will suspend the funds transfer pending the outcome of their review. You can also dispute the charges on a credit card if that was used in the payment. Third, elevating your more and more frequent emails from the " I am unhappy with this transaction and want a refund" to "I remain unhappy and will be filing a grievance with ebay and Paypal and considering filing poor feedback with Ebay" level to the "I have cancelled my credit card payment for this transaction and will be filing poor feedback on ebay unless the payment is returned forthwith (used your own language)". Just make sure to keep the pressure on, maintain copies of your communications, maintain your cool and businesslike manner, and get it all done within 30 days of payment so that you can actually file the grievances as described above. I hope when you returned it you did so in such a way to prove that it actually got back to the original vendor (trackable shipping with delivery verification).

    Yup, delivery verification - got the tracking info from USPS.....

    I hate to escalate it, but a vendor demands payment before shipping an item, I expect the same......

    I am not taking exception to anything you said but would add, if you use PayPal to pay someone and the transaction was not on EBay it does change your ability to address the issue. I had a recent experience going through this, and if you read the TOS for PayPal this becomes pretty clear.

    An even murkier issue comes up with challenging through your credit card company. I bet 5 people calling the bank will get 5 different answers. The reason I say this was that bank pointedly said the charge was from PayPal not from Merchant Name Withheld. So they were saying disputing the charge was in essence disputing the PayPal charge not the merchants. Although this got very convoluted. Very confusing, lots of different answers no clear understanding.

    Well, all I was asking for from this vendor was that a refund was in process.

    I paid by PayPal, and expected the refund to go through PayPal.

    This vendor finally replied after I filed a dispute via PayPal. (Granted, the dispute system on PayPal isn't really set up for this sort of thing - either item not received or item not as described - I picked one for no particular reason)

    I was just informed that a check had been sent on Feb. 8.

    All that had to occur was to respond to my first email asking if the refund was in process.

    Now they are threatening me because they feel I was impatient - they had the glengarry for 5 days before responding to a single email. (Oh - I forgot to add, they are practically demanding an apology for my impatience and my lack of respect for their courtesy)

    If the vendor accepts PayPal, they should have the technical savvy to also refund through PayPal.

    I will never do business again with anyone with an aol.com email address.....

    This was not worth the $35 for the hat......
