The Copyright Claimant
The copyright claimant is either the author of the work or a person or organization that has obtained ownership of all the rights of the copyright initially belonging to the author. This category includes anybody that obtained or bought by contract the right to claim legal title to the copyright.

Thank you for the generic definition, and apologies for not being clearer in my question: what is his personal interest in the Texas Bluebonnet tartan? Is he a relative of McRoberts, an active member of the Texas Scottish Community, etc.
I certainly support the rights of copyright holders, but given that the Texas tartan is the symbol of the contributions of the Scots to Texas, as well as the State of Texas, one would hope that the copyright claimaint had a desire to use that symbol to promote the history and heritage of the Scots in Texas.
Here's another question for one of our resident barristers: can a state symbol be copyrighted?

He does want to use it to promote the history and heritage.
This whole Texas Bluebonnet Copyright issue is only an issue because Scotland Forever has been claiming to have the sole right to produce and sell the tartan. They have been so convincing that even Rocky believed them...."it should ONLY be Scotland Forever (from Texas) or USA Kilts. We're the only 2 with current permission to weave this tartan from the designer."
Many other people also believed them.

Ladies and Gentlemen,
The Staff have been watching this thread closely as it has the potential to get real ugly, real fast.
There are issues of Copyright involved here and that means the potential for someone to make or lose a lot of money.
As this thread seems to be developing into a public fight between two members of this forum the Original Author of this thread has asked that this thread be closed.
The Staff agree that this forum is not the appropriate place for a public mud throwing contest.
The facts of who does, and who does not, have permission to weave and sell the Texas Bluebonnet Tartan are still being worked out in private.
