Help a Hero
Found this in the news today http://www.comcast.net/articles/news.../US.Flag.Flap/ Col. Barfoot is a WWII CMH winner who is having difficulties with the local home owners assn. over displaying his flag on a 22 foot flag pole in his front yard. While I do support Colonel Barfoot, I want to point out, before this gets a political spin is that it is not political. Apparently, there is something in an agreement with "The Homeowner's Association" which says that the sub-division residents can't have a flag pole. American flags are allowed, but only those small ones on the slanted poles attached to the house.However, I do think that, considering who the resident is(A living Medal of Honor recipient) the Homeowners Association should allow it.

Personally, I think he should be allowed to have the flag and pole. Too many HOAs have that rule which, to me, should not be.
NOW, on the HOA side... When you purchase a house where there is an HOA, you have the rules/bylaws or whatever that HOA calls them. You know in advance and have the chance at that time to NOT purchase the house. The HOA has those rules to keep the neighborhood looking good, houses similar in upkeep and house pricing at it's best.

I do agree with you that HOA should allow Colonel Barfoot to display his flag. However, after doing a little research into the laws if I read it correctly which I might not have, the HOA might be in violation of federal law specifically Chapter 1 section 3 and 4 of the US code and HR 42.

Oh for crying out loud, would it be too much to expect a little common sense and judgment on the part of the HOA, and the willingness on their part to make an exception for a person whose life story certainly justifies it. Of course they're allowed to have their rules, and certainly those who buy into an association know the rules beforehand...nevertheless, it's small minded in the extreme on the association's part not to recognize that this gentleman's service should earn him some latitude. If anyone's ever earned the right to hoist the flag to the sky, it's this man.

While the HOA may have the legal "right" to get him to remove the flagpole, I think they are making a serious error here, in the case of Col. Barfoot. I'm sure that by now, they are kicking themselves in their collective a$$es for opening this rather unpopular can of worms... I strongly doubt that they've received much support for their side of this brou-ha-ha, and just hope they recognize the uniqueness of the person at the center of this storm.
I hope Col. Barfoot is allowed to keep his flagpole, and continue to fly our flag.
